Welcome to the Wonders Center. To ensure a safe and secure environment for our guests, you agree to the following terms and conditions, release of liability, waiver, prohibitions, and rules of behavior. By purchasing an admission ticket(s) and/or by making a reservation(s), and in consideration thereof, and in consideration for being able to visit and/or participate in attractions, exhibits, shows, and activities at the Wonders Center, I agree, understand, and acknowledge, on my own behalf and on behalf of any individual who uses a ticket or reservation made by me, as follows:
Waiver: On my own behalf and on behalf of my heirs, executors, personal representatives, administrators, and assigns, I agree to forever waive, covenant not to sue, release, and discharge the Released Parties, named below, from any and all liability, claims, causes of action, damages, costs, or expenses of every kind, including all claims and causes of action based on the sole, joint, active or passive negligence of any of the Released Parties, arising out of or in any way relating to accident, incident, injury, physical harm, death, any other situation that may arise, and/or my failure to read and follow the Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior during my visit to and/or participation in attractions, transportation, and activities at the Wonders Center. This waiver of liability and the assumption of risk set forth above is intended to be as broad and inclusive as is permitted by law.
Acknowledgment Of Assumption Of Risk And Waiver By Other Users: I attest, acknowledge, and agree that any individual for whom I have bought a ticket or made a reservation or who uses a ticket, or reservation made by me has independently and carefully read this Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior and has knowingly and independently acknowledged and agreed to all its provisions, including without limitation (1) to voluntarily assume any and all risks in any way related to accident, incident, injury, physical harm, death, any other situation that may arise, and/or my failure to read and follow the Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior, including illness, injury, or death of himself, herself, or others, and including without limitation, all risks based on the sole, joint, active or passive negligence of any of the Released Parties, named below, and (2) to agree, on his or her own behalf and on behalf of his or her heirs, executors, personal representatives, administrators, and assigns, to forever waive, covenant not to sue, release, and discharge the Released Parties, named below, from any and all liability, claims, causes of action, damages, costs, or expenses of every kind, including all claims and causes of action based on the sole, joint, active, or passive negligence of any of the Released Parties, arising out of or in any way relating to accident, incident, injury, physical harm, death, any other situation that may arise, and/or my failure to read and follow the Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior during his or her visit to and/or participation in attractions, transportation, and activities at the Wonders Center.
Waiver On Behalf Of Minor Children: For any minor child for whom I have bought a ticket or made a reservation or who uses a ticket, or reservation purchased and/or made by me, I agree and acknowledge that I am the minor child’s natural and/or otherwise legal guardian and I am authorized to and do waive and release, in advance, any of the following that would accrue to the minor child: any and all liability, claims, causes of action, damages, costs, or expenses of every kind, including all claims and causes of action based on the sole, joint, active or passive negligence of any of the Released Parties, arising out of or in any way relating to accident, incident, injury, physical harm, death, any other situation that may arise, and/or my failure to read and follow the Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior during the minor child’s visit to and/or participation in attractions, transportation, and activities at the Wonders Center.
Third-Party Beneficiaries: I acknowledge and agree that any individual for whom I have bought a ticket or made a reservation or who uses a ticket, or reservation made by me is and is intended to be a third-party beneficiary of that ticket, or reservation made by me.
Indemnity/Insurance: On my own behalf and on behalf of my heirs, executors, personal representatives, administrators, and assigns, I agree to indemnify and hold each of the Released Parties harmless from and against any and all claims made or incurred by anyone, including myself and any individual who uses a ticket, or reservation made by me, arising out of or in any way relating to my purchase of an admission ticket(s) and/or my making of a reservation(s), and subsequent visit to and/or participation in attractions, transportation, and activities at the Wonders Center, wherever such activities may occur and whether suffered before, during, or after such participation. My indemnification obligations shall include, without limitation, all attorneys’ fees and costs incurred by any of the Released Parties through and including any appeals. I understand and agree that I am not relying on the Released Parties to have arranged for, or carry, any insurance of any kind for my benefit relative to my visit to and/or participation in attractions, transportation, and activities at the Wonders Center, and that I am solely responsible for obtaining any mandatory or desired life, travel, accident, property, or other insurance related to my visit to and/or participation in attractions, exhibits, shows, and activities at the Wonders Center, at my own expense.
Scope: I agree that the Waiver and Indemnity provided for in this Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior shall cover all physical and emotional injuries and/or damages, including without limitation all illness and bodily injury (including death), whether suffered by me or anyone else before, during, or after my visit and/or participation. Additionally, I agree that the scope of the Waiver and Indemnity shall include any claims related, in whole or in part, to my own actions and the actions of third parties, whether foreseeable or unforeseeable.
Term: The Waiver and Indemnity provided for in these Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior applies to any and all visitation to and/or participation in attractions, transportation, and activities at the Wonders Center and/or presence on the Released Parties’ property arising out of the purchase of an admission ticket(s) and/or the making of a reservation(s), and/or the use or rental of the facility, pursuant to which I and the Released Parties agreed to this Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior, from the date of execution.
Released Parties: The Released Parties are: The Wonders Center, David Rives Ministries, David Rives, Wonders Center & Science Museum, Genesis Science Network, The Creation Superstore; and their respective parents, subsidiary, and other affiliated or related companies, and all officers, directors, employees, shareholders, members, agents, contractors, sub-contractors, representatives, successors, assigns, insurers, and volunteers of each of the foregoing entities.
Severability/Partial Invalidity: If any provision or part thereof of this waiver and these terms and conditions is held to be invalid, void, or unenforceable by a court of competent jurisdiction, such provision or part thereof shall be deemed modified to conform to applicable law, or if this would cause an illogical or unreasonable result, such provision or part thereof shall be stricken from this waiver and these terms and conditions. In such a case, all other portions of this waiver and these terms and conditions will remain valid and applicable.
Binding Arbitration: I AGREE THAT, UPON ELECTION BY EITHER PARTY, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING UNDER OR RELATING IN ANY WAY TO THESE TERMS AND CONDITIONS, NOW OR IN THE FUTURE WILL BE RESOLVED BY BINDING ARBITRATION. CLAIMS SUBJECT TO ARBITRATION INCLUDE COUNTERCLAIMS, CROSS CLAIMS, THIRD PARTY CLAIMS, INTERPLEADERS, OR ANY OTHER CLAIMS, WHATEVER THE CAUSE(S) OF ACTION ASSERTED (INCLUDING CLAIMS FOR INJUNCTIVE, DECLARATORY, OR EQUITABLE RELIEF). I ACKNOWLEDGE AND AGREE THAT ARBITRATION REPLACES MY RIGHT TO GO TO COURT. I THEREFORE AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO LITIGATE ANY CLAIMS IN COURT BEFORE A JUDGE OR JURY. I AGREE THAT I THEREFORE WAIVE ANY RIGHT TO LITIGATE ANY CLAIMS IN COURT AS A CLASS ACTION OR OTHER REPRESENTATIVE OR COLLECTIVE ACTION (SUCH AS AN ACTION IN THE FORM OF A PRIVATE ATTORNEY GENERAL). I ALSO AGREE TO WAIVE ANY RIGHT TO PURSUE IN ARBITRATION ANY CLASS ACTION OR OTHER REPRESENTATIVE OR COLLECTIVE ACTION (SUCH AS AN ACTION IN THE FORM OF A PRIVATE ATTORNEY GENERAL), OR TO PARTICIPATE AS A CLASS MEMBER IN A CLASS ACTION OR OTHER REPRESENTATIVE ACTION IN ARBITRATION OR IN COURT BEFORE A JUDGE OR JURY. I ALSO AGREE THAT NO ARBITRATION OR PROCEEDING CAN BE COMBINED WITH ANOTHER WITHOUT THE PRIOR WRITTEN CONSENT OF ALL PARTIES TO THE ARBITRATIONS OR PROCEEDINGS.
The arbitrator will have the exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of these terms, including the arbitrability of any dispute and any claim that all or any part of these terms and conditions is void or voidable.
In the event of a dispute, I agree to send a notice of dispute, which is a written statement that sets forth my name, address, and contact information; the facts giving rise to the dispute; and the relief requested to the Released Parties at PO Box 1948, Dickson, TN, 37056, USA, Attention: Legal. The Released Parties will send any notice of dispute to me at the contact information that they have for me. The Released Parties and I will attempt to resolve a dispute through informal negotiation within ninety (90) days from the date the notice of dispute is sent. After that ninety (90) day period and not before, the Released Parties or I may commence an arbitration proceeding.
If the Released Parties and I do not resolve a dispute by informal negotiation, the dispute shall be resolved by binding arbitration before a neutral arbitrator whose decision will be final except for a limited right of appeal under the Federal Arbitration Act, 9 U.S.C. § 1 et seq. Arbitration will be administered by JAMS Mediation, Arbitration and ADR Services (“JAMS”) in accordance with the JAMS Streamlined Arbitration Rules and Procedures (the “JAMS Rules”). The JAMS Rules and instructions about how to initiate an arbitration are available at www.jamsadr.com or 1-800-352-5267. Arbitration may be conducted in person, through the submission of documents, by phone, or online. Proceedings that cannot be conducted through the submission of documents, by phone, or online, will take place in Tennessee. The Released Parties and I agree to submit to the exclusive jurisdiction of the federal or state courts located in Dickson County, Tennessee in order to compel arbitration, to stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator. The arbitrator may award damages to me individually as a court could, including declaratory or injunctive relief, but only to the extent required to satisfy my individual claim. In accordance with the JAMS Rules, the party initiating the arbitration (either me or the Released Parties) is responsible for paying the filing fee. However, if the arbitrator issues me an award of damages and: (a) that award is greater than the amount of the Released Parties’ last written settlement offer; or (b) if the Released Parties did not make a settlement offer, then in addition to paying for any JAMS Case Management Fees and all professional fees for the arbitrator’s services, the Released Parties will reimburse me for the filing fees I incurred.
Except as provided above with respect to jurisdiction in Dickson County, Tennessee, nothing in this arbitration provision shall be construed as consent by the Released Parties to the jurisdiction of any other court with regard to disputes, claims, or controversies unrelated to this agreement.
This agreement to binding arbitration evidences a transaction in interstate commerce, and thus the Federal Arbitration Act, 9 U.S.C. §§ 1-16, governs its interpretation and enforcement. This agreement to binding arbitration will survive its termination. If any portion of this agreement to binding arbitration is deemed invalid or unenforceable, the remaining portions shall nevertheless remain in force.
Governing Law: These terms and conditions, including this Terms and Conditions, Release of Liability, Waiver, Prohibitions, and Rules of Behavior shall be governed by the laws of the State of Tennessee.
COVID-19, Health Risks, and Communicable Diseases Waiver: You acknowledge that, although the Company has taken precautions to secure the safety of guests at the Wonders Center and prevent exposure to COVID-19 (coronavirus), or other viruses or health risks, no facility can guarantee against exposure or infection. By purchasing your Wonders Center ticket(s), you agree to assume the risk of such exposure and enter the Wonders Center at your own discretion, and agree to forever release from liability and waive the right to bring suit against the Company for any such exposure or infection in any way related to the Company’s services or premises, to the fullest extent permitted by law.
General Terms:
-The Wonders Center is private property, a Christian environment, and outreach of the Company. By visiting the Wonders Center, you agree to act in a polite, respectful manner at all times while on Wonders Center property.
-In the interest of public safety all persons, bags, packages, clothing, and other items are subject to security screening and/or inspection by Wonders Center personnel at any time. Also, within the Wonders Center, all vehicles on, entering, or exiting the premises are subject to search or inspection by Wonders Center personnel at their discretion.
-We reserve the right to not allow any bag, package, or any other item to be brought into the Wonders Center, and to deal with any unattended item or object in a manner we consider appropriate.
-All guests and items on their person are subject to being searched prior to entry into the Wonders Center, including members of the media. By requesting entry into the Wonders Center, all guests are agreeing to be subjected to a thorough pat-down search, including emptying pockets and bags, and having those items examined. Individuals not agreeing to the aforementioned security measures will not be permitted into the Wonders Center. Public Safety Officers shall, at all times, reserve the right to either deny any person entry into or to eject any person from the Wonders Center, who in the sole and absolute discretion of the Wonders Center are in violation of rules, which rules may be updated from time to time, with or without notice.
-All visitors must show courtesy to fellow guests, volunteers, and employees by not using profanity or engaging in unsafe, illegal, disruptive, or offensive behavior. For your safety and the safety of others, please refrain from running and from climbing railings, fences, and barriers, or climbing any structure.
-Proper attire, including shoes and shirts, must be worn at all times. Any form of costume, disguise or full face mask may not be worn by guests. Masks worn by persons over the age of 10 may cover the nose and mouth areas only. Clear face shields are permitted. We reserve the right to deny admission to or remove any person wearing attire that we consider inappropriate, or attire that could be considered offensive, disrespectful, or inappropriate to others.
-For the comfort of all guests and employees, smoking of tobacco, e-cigarettes, or any other products that produce a vapor or smoke are allowed only in designated smoking areas.
-Children should be supervised at all times. All persons under age 18 must be accompanied by an adult to enter.
-The Wonders Center, including the Heavens Declare Planetarium and its designated roadways, walkways, and parking areas, is private property.
-No Soliciting.
-Park at your own risk. We are not responsible for loss or damage of vehicles, belongings, or property, consistent with applicable law.
-Photography, videotaping, or recording of any kind for commercial purposes is prohibited, including any unlicensed use of photographic images or recordings of the attraction or its exhibits for “editorial” use, or the sale, distribution or downloading of any such images or recordings for “editorial” purposes, unless written permission or a written license is obtained.
-We reserve the right to deny admission, prevent entry, or require a person already admitted to leave the Wonders Center or any party thereof, without refund, liability or compensation, for failure to comply with any of these rules, for unsafe, illegal or offensive behavior, to ensure safety, security or order, or if we consider that the circumstances otherwise so require, in our sole and absolute discretion.
-We may from time to time, in our sole and absolute discretion, without prior notice and without refund, liability or compensation, change the operating hours, close the Wonders Center, particular exhibits, or any part of it temporarily, restrict the number of persons having access to the facility and/or suspend or cancel any program if we consider that the circumstances so require.
Wonders Center rules and regulations are subject to change at any time without notice. We reserve the right to prohibit any other activity that we determine may be harmful or disruptive, in our sole and absolute discretion.
Prohibited Items – These may not be brought onto the premises of the Wonders Center:
-Bags larger than 16 x 12 x 4.
-Illegal or illicit substances, drugs, or drug paraphernalia.
-Marijuana (including marijuana enriched products) or any illegal substance.
-Alcoholic beverages.
-Weapons of any kind, or objects that could appear to be weapons, including, but not restricted to, knives, firearms, ammunition, and long poles, including selfie-sticks.
-Objects or toys that appear to be firearms or weapons.
-Self-defense or restraining devices (e.g., pepper spray, mace).
-Visible tattoos that could be considered inappropriate, such as those containing objectionable language or designs.
-Flammable items or liquids including aerosols and fireworks or other similarly explosive and/or flammable objects, smoke machines, or fog machines.
-Markers, Sharpies, or spray paint.
-Cans, canteens, glass containers, glass bottles, or coolers (excluding small containers such as baby food jars) are not permitted on site (inside or outside) at the Wonders Center but may be stored in vehicles.
-Picnics and picnic-type foods are allowed in designated outdoor areas only. Food may be brought inside only when required by allergy restrictions. Please inquire with our café regarding special dietary needs.
-Balloons, balls, inflatable balls, Frisbees, or flying disks.
-Laser pens, laser pointers, or similar focused light devices.
-Water guns, squirt guns, or any toy item that could be perceived as a gun.
-Musical instruments (except if you have received a written and signed consent from the Wonders Center).
-Professional cameras, drones, or unmanned aerial vehicles without express written consent from Wonders Center leadership.
-Selfie-sticks, camera tripods, gimbals/stabilizers.
-Hand-held extension poles of any kind, flags, and banners.
-Horns, whistles, megaphones, air horns, or artificial noise makers.
-Recreational devices such as drones, remote-control toys, skateboards, scooters, hover-boards, inline skates, bicycles, or shoes with built-in wheels.
-Strollers that are greater than 31″ (79 cm) in width and 52″ (132 cm) in length.
-Wagons, including stroller wagons.
-Any trailer-like object that is pushed, pulled or towed by an Electric Conveyance Vehicle, wheelchair, stroller or person.
-Wheeled mobility devices with less than 3 wheels or devices that cannot maintain stability and balance when stopped, unpowered and/or unoccupied. Training wheels and/or modifications are not permitted. Devices must be manually or electrically powered and operated at a walking pace. Devices should be single rider and not exceed 36″ (92 cm) in width and 52″ (132 cm) in length.
-Suitcases, bags, coolers, backpacks, and folding chairs.
We reserve the right to prohibit the use or presence of any other item not listed above that we determine may be harmful or disruptive, in our sole and absolute discretion.
Prohibited Activities:
-The sale of goods or services, or the display of goods or services, unless prior written approval has been obtained.
-The distribution of printed or recorded materials of any kind unless prior written approval has been obtained.
-Engaging with other Guests or impeding operations while posing as or portraying any character in costume.
-Engaging in any unsafe act or other act that may impede the operation of the Wonders Center or any part thereof.
-Unauthorized access or entry into backstage areas or areas designated only for Cast Members.
-Unauthorized events, speeches, or use of any flag, banner, sign or other material for commercial purposes, or as part of a demonstration.
-Photography, videotaping or recording of any kind, or otherwise engaging in any activity, for unapproved commercial purposes.
-Unauthorized solicitations of any kind, whether commercial, religious, educational, or otherwise, or conducting any unauthorized commercial activities, including solicitations of money or other contributions or donations.
-Obstructing sidewalks, entrances, driveways, patios, vestibules, stairways, corridors, halls or landings.
-No disruptive behavior, shouting, cursing, heckling, engaging with staff, visitors, or volunteers in an unprofessional manner. Any such activities are subject to removal from grounds and revocation of ticket or membership without refund.
-Selling of any goods or services not authorized by the Wonders Center
-Distributing any printed materials or recorded materials of any kind
-Unauthorized demonstrations, religious ceremonies, or speeches
-Engaging in unsafe acts or behaviors
-Vandalism will be prosecuted to the fullest extent. The Wonders Center property and facilities are under video surveillance.
-Feeding, petting, touching, harassing, or harming any wildlife, including birds, is prohibited.
-Camping and/or overnight or extended parking on the premises is not permitted and is strictly prohibited. Action including towing and/or removal of the offending vehicle at owner’s expense.
Seizure / Flashing Lights / Loud Noises waiver: Persons who have photo sensitive epilepsy or are subject to seizures due to flashing lights at certain light intensities and frequencies are cautioned that some areas of the Museum and some shows do produce flashing, flickering, and varying brightness level lighting effects. Loud sounds, high-voltage electricity, and other effects may be part of displays or shows.
Service Animals: Service animal means a dog or miniature horse that is trained to do work or perform tasks for, and to assist, an individual with a disability. All other animals, including emotional support, comfort, therapy, or companion animals, are not considered service animals and are not permitted. Pets and all other animals, except service animals (i.e., dogs and miniature horses, as defined above) are strictly prohibited. Service animals should remain on a leash or in a harness and under the control of the owner at all times. Due to the dark conditions, flashing lights, and other conditions in the planetarium, service animals may not be brought into the planetarium at any time.
Likeness Release and Contact Permission: Your purchase, possession, and/or use of a ticket automatically grants permission to David Rives Ministries and/or the Wonders Center to record your image, likeness, and audio, that of your property, via photography, film, videotape, digital medium, audio, or any other medium and otherwise reproduce the image and/or voice of any person who enters the Wonders Center for security, safety, news, marketing promotions, or other purposes, without payment to that person, and constitutes a release to use such image and audio for any or all such purposes. By your purchase, possession, and/or use of a ticket, you agree to receive David Rives Ministries and/or the Wonders Center’s updates and newsletters via email, direct-mail, and other form of communication.
Ticket, Pass, and Membership Conditions: Tickets, credentials and other entitlements are non-transferable, non-exchangeable, non-refundable, revocable and void if altered. The ticket must be used by the same person on all days during its period of validity and is not valid for special events that require a separate admission charge. Applicable ticket and valid identification confirmation are required for entry, re-entry or if applicable, crossover into any special event on each day of the ticket’s validity. Tickets used to redeem or access benefits or entitlements must be the same ticket used for entry.
-Day Ticket purchases are good only for the day purchased.
-Event Tickets or passes are good only for the specific event for which they have been purchased.
-Annual Passes expire one year from the date of purchase unless otherwise noted.
-Tickets and passes may not be copied, loaned, transferred, or resold.
-Tickets and passes are revocable by the Wonders Center without explanation.
-No refunds will be issued. All sales are final.
-Each ticket allows entry for only one (1) person.
-Ticket and pass allows bearer admission to facilities only during operating hours.
-Photocopies of tickets and passes will not be accepted.
-Unauthorized duplication or sale of tickets and passes may result in denial of admission to the Wonders Center.
-Valid Photo ID is required for pass usage and for some events.
